1. Definitions & Scope

These Terms apply to all visitors, customers, and users of our online store. Throughout the site, the terms “we”, “us”, and “our” refer to Kinasih Spices & Herbs. By checking the agreement box at checkout and completing a purchase, you form a legally binding contract subject to these conditions.

2. Order Placement & Eligibility

By placing an order, you represent that you are at least the age of majority in your state or country of residence and have the legal capacity to enter into a contract.

• Accuracy of Information: You agree to provide current, complete, and accurate contact, recipient, and address details (including a valid email address and phone number) for all purchases.
• Guest Checkout: You may check out as a guest without creating an account. In both cases, the contract is finalized only when we capture your payment and generate a unique tracking token.
• Right of Refusal: We reserve the right to cancel or refuse any order at our sole discretion, including cases where fraud is suspected, stock is depleted, or pricing is listed incorrectly.

3. Pricing, Payments, and Taxes

All prices are displayed in USD (United States Dollars).

• Currency & Conversion: All order values are calculated and stored internally in the smallest currency unit (cents). Exchange rate fluctuations for international customers are determined by your payment provider.
• PayPal Processing: All transactions are securely completed through PayPal. Orders are authorized at checkout and captured upon verification of stock availability.
• Import Duties: For cross-border deliveries, you are solely responsible for paying any local customs duties, taxes, tariffs, or import fees levied by your country's customs authorities.

4. Voucher & Promotional Code Rules

Vouchers and promo codes are subject to specific activation parameters, minimum order values, and expiration dates. A voucher is deemed redeemed only when an order is finalized and paid for. We reserve the right to revoke or void voucher benefits if we detect automated probing, brute forcing, or multiple accounts created to bypass usage limits.

5. Food Safety, Returns, and Risk of Loss

We uphold the highest quality and hygiene standards for our food-grade spices and agricultural products.

• Returns Restraint: Due to international food safety regulations and the perishable nature of herbs and spices, we cannot accept returns on opened, unsealed, or used items.
• Defective Shipments: If your product arrives damaged or defective, you must report it within 14 days of delivery with photographic evidence to initiate a refund or replacement.
• Risk of Loss: All items purchased from Kinasih are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery of the parcel to our shipping carriers.

6. Intellectual Property

All content on this website, including but not limited to logos, horizontal/stacked brand graphics, simple icons, layout structures, product descriptions, images, recipes, and text, is the property of Kinasih Spices & Herbs and is protected by international copyright, trademark, and intellectual property laws. You may not copy, reproduce, or redistribute any materials without our prior written consent.

7. Disclaimer of Warranties & Limitation of Liability

We do not guarantee that our service will be uninterrupted, secure, or error-free. Our products are provided “as is” without warranties of any kind, either express or implied, including warranties of merchantability or fitness for a particular culinary purpose. In no event shall Kinasih Spices & Herbs, its founders, directors, employees, or logistics partners be liable for any direct, indirect, incidental, or consequential damages resulting from the use or consumption of our products.

8. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from or relating to these Terms or your use of our store shall be resolved exclusively through the competent courts of Indonesia.
